Heute erreichte mich ein Schreiben vom Rechtsanwalt Hans-Werner Kallert aus der Kanzlei HWK. Offensichtlich richtet er diese Massenabmahnungen nicht nur an mich.
Er wirft mir vor, hier auf der Facebook-Seite https://www.facebook.com/pages/SMS-Frankfurt-Agency-for-digital-Media/124114644271435 kein Impressum eingebaut zu haben.
Er vertritt die Firma Binary Services GmbH, verteten durch Florian Blischke und Marco Hahn.
Dabei existiert bereits sogar auf der Startseite ein Impressum. Außerdem habe ich selbstverständlich alle Kontaktdaten gemäß der Internetimpressumspflicht auf der Seite veröffentlicht. Nicht jedoch alle Informationen auf der Startseite.
Um den Anforderungen des § 312c Abs. 1 Satz 1 BGB an eine klare und verständliche Zurverfügungstellung der Informationen i.S. von § 1 Abs. 1 BGB-InfoV im Internet zu genügen, ist es nicht erforderlich, dass die Angaben auf der Startseite bereitgehalten werden. Hätte der Anwalt sich die Seite genau angesehen, so wären ihm die Impressumseinträge sicher aufgefallen. Aber bei dieser Menge von Facebookabmahnungen kann man natürlich nicht alle Seiten genau ansehen. Etwas Schwund ist da immer und es gibt sicher immer noch genug gutgläubige Bürger welche sich umgehend von einer solchen Massenabmahnung beeindrucken und einschüchtern lassen.
Wenn der Kläger oder der Anwalt das Impressum nicht findet, weil er einfach nur “blind” möglichst viele Abmahnungen schreibt, so ist dies nicht dem Seiteninhaber oder -ersteller anzulasten. Ein mitgesendeter Screenshot soll zur Beweisführung dienen. Dieser zeigt jedoch nur die Startseite, aus welchem jedoch klar Scrollbalken ersichtlich sind. Der Screenshot ist zudem wohl absichtlich nicht vollständigt, zeigt er nämlich nur einen kleinen Ausschnitt. Man kann daher davon ausgehen, dass die Seite bewusst unvollständig angezeigt wurde. Die würde jedoch bedeuten, dass mich der Anwalt bewusst täuschen wollte, was im Gegenzug allerdings eine Straftat laut § 263 (1) StGB darstellt.
In seinem Anschreiben wurde ich aufgefordert, eine Unterlassungsverpflichtungserklärung zu unterschreiben, in der ich mich verpflichten würde, dem Geschädigten die Kosten zzgl. Auslagenpauschale zu überweisen. Solch eine Unterschrift werde ich selbstverständlich nicht leisten, denn erst dadurch, würde ich mich bereit erklären die geforderte Summe erstatten zu wollen. One of the last automobile adventures of this World, the old and youngtimer rally from the Allgäu region in southern Germany to the Orient and specifically to Baku in Azerbaijan was started 28th of April 2012 for the seventh time in Oberstaufen.
It was also in the year 2012 the Low Budget Rally for the people, who dream of participating in a calculable adventure. The rally is a cheap alternative for Paris-Dakar for strong Teams and good mooded people.
La Playa Camp Ground & Picnic Grounds – looks like a nice place, but the management is serious cheating on guests and clients. – We had just lately about 29 complains from a bigger group… – Suddenly the management of La Playa did charge for guests which were already gone and had paid already – same with people who share a room, La Playa tries to get the whole amount for the room from all parties sharing.
Beside this dont do their tours – their boats are not really safe and the always get more people on the boat as allowed!!! – You risk your life! In our case they put at least 30 people in a boat for 14-16 people!!! Good Luck with that – La Playa, sorry – never ever again!

Some ideas of the original story (movie) which gave us the idea for this trip – which will be “ofcourse” different from the story! Around the World in Eighty Days (French: Le tour du monde en quatre-vingts jours) is a classic adventure novel by the French writerJules Verne, first published in1873. In the story, Phileas Fogg of London and his newly employed FrenchvaletPassepartout attempt to circumnavigate the world in 80 days on a £20,000 wager (equal to £1,324,289 today) set by his friends at the Reform Club. It is one of Verne’s most acclaimed works.
The story starts in London on October 2, 1872. Phileas Fogg is a rich English gentleman and bachelor living in solitude at Number 7 Savile Row, Burlington Gardens. Despite his wealth, which is £40,000 (equal to £2,648,577 today), Mr Fogg, whose countenance is described as “repose in action”, lives a modest life with habits carried out with mathematical precision. Very little can be said about Mr. Fogg’s social life other than that he is a member of the Reform Club. Having dismissed his former valet, James Forster, for bringing him shaving water at 84 °F (29 °C) instead of 86 °F (30 °C), Mr Fogg hires a Frenchman by the name of Jean Passepartout, who is about 30 years old, as a replacement.
Later, on that day, in the Reform Club, Fogg gets involved in an argument over an article in The Morning Chronicle, stating that with the opening of a new railway section in India, it is now possible to travel around the world in 80 days. He accepts a wager for £20,000 from his fellow club members, which he will receive if he makes it around the world in 80 days. Accompanied by Monsieur Passepartout, he leaves London by train at 8:45 P.M. on October 2, 1872, and thus is due back at the Reform Club at the same time 80 days later, on December 21.

THE VODKA TRAIN ADVENTURES
We understand this is the right name for an adventure trip on its own. Travelling on the Russian-/Mongolian-Railway from Moscow to Beijing. More than 5.000 Miles, 18 Days, 10 Cities, 7 Time Zones, 3 Countries, 2 Continents and just ONE ORIGINAL VODKA TRAIN.
Usually we do this trip 1-2 times a year. We have one summer tour and a shorter version in winter.
Beside this we offer a wide range of other adventure- and sports trips and events. Most of our tours are in Eastern Europe, Russia, Central Asia.
Just recently we started also in other parts of Asia as Philippines, Thailand, China and Malaysia as well as Australia and New Zealand.
We design and develop also individual and special events for your company or your personal adventure trip.
Our groups have a maximum size of not more than 8 – 10 participants and all trips are provided with English/German speaking guides which usually speak at least one other language beside the country language we are travelling in.
